A new section was added to provide that the commission shall prescribe appropriate penalties for a violation of any act or regulation under this chapter or any laws or rules and regulations in writing accepted by the Commission as a basis of prices for materials or services.

This section was amended to authorize Commission action to prove the fact of injury or damage to be that for which damages are recoverable, and not necessarily that for which damages are claimed, under any action, proceeding or lawsuit, and the time for presentation of such proof shall be fixed by the Commission.

For all railroads operating intrastate in Virginia, the provisions for review of operating expenses shall also apply to the intrastate railroads and Rail Labor Agreements. For such railroads the Commission shall, as it now does for interstate railroads, provide for an authority to review and approve or disapprove the agreements that it shall fix a minimum charge upon the railroads to be charged by the railroads for the services of employees in the performance of their duties. And no agreement between the railroads and their employees participating in this provision shall be approved or contracted to be performed by the railroads, whether involving the performance of duties by rail crew or by other employees, until the railroads shall have filed with the Commission an average schedule of such minimum charge and have made a report to the Commission of the average cost as shown by the schedule of such charge from which the Commission shall have the same authority to approve or disapprove any agreement heretofore granted by the Interstate Commerce Commission. d2c66b5586
